Sound Mitigation & Landscaping Issues

  • Point of Sale: Buyers were shown several different artist renderings promoting useable, clean and manicured common area spaces that would be enjoyed by community.

    • Sales team fostered this sales approach during tours and sales meetings.

  • Hidden Information: 2019 Sound Study mandating sound mitigation is kept from prospective buyers.

  • LOKAL "FAILS" to correctly mitigate sound for community.

    • HUD sound criteria mandating mitigation was recommended by hidden sound study

    • Utility Owners deny permanent sound mitigation structures to be installed over easements; LOKAL submits landscaping plan that does not meet acceptable sound mitigation for the condo community.

    • Builder circumvents sound mitigation for all buildings within the condo community.

    • LOKAL CHANGES the "Use-definition" of the STC north facing common area making it non-communal.

  • LOKAL Selects a landscape design to foster "non-usable" common area agenda.

  • LOKAL'S selected landscape design is better suited for open spaces, not suitable for the center of a multi-unit dwelling.

    • Waist high native grass encourages rodents, pests, dirt and weeds and makes common area "unusable" and appears "needing attention & unkempt" for all viewing the common area.
